These Terms of Use ("Terms") govern your use of the COLREG 72 mobile applications for iOS and Android (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
Who provides the App
The iOS version is published on the Apple App Store by Yury Smirnov (Russian Federation). The Android version is published on Google Play by Mikhail Smirnov (the Netherlands). In these Terms, "we" and "us" mean the publisher of the version you use. Contact: support@happyjigsaw.com.
Educational tool only
The App is an independent study and reference tool for the International Regulations for Preventing Collisions at Sea (COLREGs) and related rules. It is not a substitute for official training, official publications of the rules, professional judgment or safe navigation practice, and it must not be used as the sole reference for navigation or watchkeeping decisions.
No affiliation
The App is not affiliated with, endorsed by, sponsored by or approved by the International Maritime Organization (IMO), the U.S. Coast Guard, the Maritime and Coastguard Agency, the Australian Maritime Safety Authority, Transport Canada or any other government body, maritime administration, examining body or training institution. Names of these organisations are used only to describe the subject matter.
Rule texts and translations
Rule texts in the App are reproduced from official texts for study purposes. They may not reflect the latest amendments, national variations or local regulations, and versions in other languages may differ from the official text that applies in your country. If there is any difference between the App and an official text, the official text prevails. You are responsible for checking the rules that apply to you against official sources.
Practice questions and exams
Questions, answers, explanations, illustrations and practice exams in the App are written by us for learning. They are not taken from, and do not reproduce, any official examination question bank.
The number of questions, time limits, pass marks and format of practice exams in the App are our own and may differ from any official examination. Results in the App do not predict or guarantee results in any official examination, and using the App does not guarantee that you will pass any examination or obtain any certificate or licence.
Accuracy and corrections
We work to keep the content accurate, but the App may contain errors, omissions or outdated information, including in answers, explanations, illustrations, translations and rule references. If you find an error, please report it to support@happyjigsaw.com or with "Report an error" in the App. We may correct, change or remove content at any time without notice.
Purchases and access
On iOS the App is sold as a paid app through the Apple App Store. On Android the App is free to download and offers optional paid access through Google Play, processed with RevenueCat. Billing, refunds and purchase management are handled by the store you used.
We may change content, features and prices. Access you have already paid for remains subject to the purchase terms shown by the relevant store.
Advertising (Android)
The Android version may show advertising provided by Google and may ask for your consent to personalised advertising where required by law. See the Privacy Policy.
Acceptable use
You may use the App for personal study and exam preparation. You may not misuse the App, attempt to disrupt its services, reverse engineer restricted parts of the App, or copy or redistribute its paid content or question bank without our permission.
Disclaimer of warranties
The App and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose (including passing an examination) and non-infringement, to the extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from navigation decisions, examination results or reliance on the App's content. Our total liability for any claim relating to the App is limited to the amount you paid for the App or in-app access in the twelve months before the claim, or USD 10 if you paid nothing.
Your statutory rights
Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded under the law of your country of residence.
App Store terms (iOS)
These Terms are between you and the publisher of the iOS version, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation for the App, and any claims relating to the App are the publisher's responsibility. Apple and its subsidiaries are third-party beneficiaries of these Terms. The Apple Standard Licensed Application End User License Agreement also applies to your use of the App on iOS.
Changes and governing law
We may update these Terms. The "Last updated" date shows the current version, and continued use of the App after an update means you accept the updated Terms.
These Terms are governed by the law of the country of the publisher of the version you use (the Russian Federation for iOS, the Netherlands for Android), without regard to conflict-of-law rules and without prejudice to your statutory rights described above.
